DMCA Policy

Gameplay Labs LLC (“Company”) respects and complies with copyright laws, including the U.S. Digital Millennium Copyright Act (“DMCA”). This page restates Sections 7 and 8 of our Terms of Service.

Company’s designated agent to receive notifications of claimed copyright infringement is registered with the U.S. Copyright Office pursuant to 17 U.S.C. § 512(c)(2):

Filing a DMCA Takedown Notice

If you are a copyright owner or an agent thereof and believe that any content on the Service infringes upon your copyrights, you may submit a written notification to our Copyright Agent containing all of the following:

(a) An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest.

(b) A description of the copyrighted work that you claim has been infringed.

(c) Information reasonably sufficient to permit us to identify and locate the allegedly infringing material. Because our content lives inside a mobile application where a URL may not be available or sufficient, please provide as many of the following as you can:

  1. The name of the game featured in the video;
  2. The length or duration of the video;
  3. A detailed description of the video’s content — for example: “Gameplay video of [Game Name]’s [specific level/character/scene], where [copyrighted music/video] is used without authorization from [start time] to [end time]”;
  4. The video file itself, clearly identifying the allegedly infringing material within the Service.

(d) Your address, telephone number, and email address.

(e) A statement that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.

(f) A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner’s behalf.

Note: Under 17 U.S.C. § 512(f), a person who knowingly materially misrepresents that material is infringing may be liable for damages, including costs and attorneys’ fees.

What Happens Next

Upon receipt of a compliant takedown notice, Company will act expeditiously to remove or disable access to the allegedly infringing material and will notify the user who uploaded the content.

Counter-Notification

If you believe that your content was removed or disabled by mistake or misidentification, you may submit a counter-notification to copyright@gameplaylabs.org containing:

(a) Your physical or electronic signature.

(b) Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or disabled.

(c) A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.

(d) Your name, address, telephone number, and email address, together with a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if your address is outside the United States, for any judicial district in which Company may be found), and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.

Upon receipt of a valid counter-notification, Company will forward it to the original complaining party and may restore the removed material if the complaining party does not file a court action within 10–14 business days.

Repeat Infringer Policy

Company terminates, in appropriate circumstances, the accounts of users who are determined to be repeat infringers of copyright. Company makes such determinations on a case-by-case basis.

Gameplay Content and Publisher Policies

Copyright in gameplay footage generally belongs to the developer or publisher of the game. Many publishers permit individuals to share gameplay videos, but the scope of that permission — including whether monetization is allowed — varies by company and can change. Users are responsible for confirming and complying with the policies of the game they record. See our Community Guideline for details.
